Copyright & DMCA Policy

1. Our Position

SiteProof respects the intellectual property rights of others and expects users to do the same. Under the Digital Millennium Copyright Act (17 U.S.C. § 512) and comparable law, we respond promptly to properly submitted claims of copyright infringement concerning material stored in our systems.

  • Content you upload — photos, videos, documents, logos and signatures — stays your responsibility. Do not upload material you do not own or have permission to use.
  • We do not operate public profiles or public galleries. Your content is only visible to your account and the people you invite.
  • Branding assets (company logos) must be your own or licensed for commercial use.

2. Material We Remove

When we receive a valid infringement notice, we will:

  • Remove or disable access to the allegedly infringing material promptly.
  • Notify the account holder that we acted on the notice.
  • Forward a copy of the notice to the account holder.
  • Terminate the accounts of repeat infringers.

3. Filing a Notice

Send a written notice to us containing all of the following:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you claim has been infringed.
  • The URL or exact location of the material you want removed.
  • Your name, address, telephone number and email address.
  • A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act on the owner’s behalf.

4. What Happens Next

We may remove the material first and then discuss it with the uploader. If the uploader disputes the claim, we may restore the material once the dispute is settled, unless the copyright owner or a court orders otherwise.

5. Misrepresentation

Under 17 U.S.C. § 512(f), knowingly and materially misrepresenting that material is infringing — or that it was removed by mistake — can make the sender liable for damages, including costs and attorneys’ fees. Claims must be made in good faith and against material that actually infringes.

6. Counter-Notices

If your material was removed and you believe that was a mistake, send a counter-notice containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the removal was the result of mistake or misidentification; your name, address and telephone number; your consent to the jurisdiction of the federal district court for the district where you reside (or any district where we can be found, if outside the United States); and a statement that you consent to the service of process from the party who filed the complaint.
