Terms of Service

1. Acceptance of Terms

By accessing or using SiteProof (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

SiteProof is a construction documentation and invoicing platform that allows users to:

  • Capture and organize project evidence (photos, videos, GPS data)
  • Generate invoices, estimates, and reports
  • Track expenses, payments, and inventory
  • Manage team members and project collaboration
  • Share documents with clients via a secure portal

3. User Accounts

  • You must provide a valid email address and accurate information to create an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • You may not create multiple accounts for the purpose of circumventing trial or subscription limits

4. Subscriptions and Billing

  • The Service is offered on a subscription basis with free, monthly, yearly, and lifetime paid tiers
  • Monthly and yearly subscriptions are billed in advance and automatically renew at the end of each billing period unless cancelled
  • Lifetime purchases are a one-time payment and do not renew
  • You may cancel a recurring subscription at any time; cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods on recurring subscriptions
  • Lifetime purchases are final and non-refundable
  • Prices are subject to change with 30 days' notice for recurring plans
  • All payments are processed securely by Paddle, our payment processor

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or in violation of these terms. Prohibited activities include:

  • Uploading malicious code, viruses, or harmful content
  • Attempting to access another user's account without authorization
  • Using the Service to send unsolicited communications (spam)
  • Reverse engineering, decompiling, or attempting to extract source code
  • Using the Service in a way that exceeds reasonable usage limits as determined by SiteProof

6. User Data and Content

  • You retain full ownership of all data and content you create using the Service
  • By using the Service, you grant SiteProof a limited license to store, process, and display your data solely for the purpose of providing the Service
  • You represent and warrant that you have the rights to any content you upload
  • SiteProof does not claim ownership of your data

7. Data Retention and Termination

  • You may export or delete your data at any time via the application settings
  • SiteProof reserves the right to suspend or terminate accounts that violate these terms
  • Upon account termination (by either party), your data will be deleted within 30 days, subject to backup retention policies
  • SiteProof is not liable for any loss of data upon termination of your account

8. Limitation of Liability

To the maximum extent permitted by law, SiteProof shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The total liability of SiteProof for any claim arising from these terms or the Service shall not exceed the amount paid by you to SiteProof in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. SiteProof does not guarantee that the Service will be uninterrupted, error-free, or secure at all times. While we take reasonable measures to protect your data, we cannot guarantee absolute security against unauthorized access.

10. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the application. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising from these terms shall be resolved in the courts of Jamaica.
